EN Plus STATEMENT OF LIMITED WARRANTY

Shenzhen EN Plus Tech Co., Ltd. (“EN Plus”) provides an electronic vehicle charging solution for home and business users. It includes an intelligent charging hardware device and an online service for control of the charging functions of the device that is accessible locally on a network and remotely through the Internet via a website and a mobile application. This limited warranty statement applies to the intelligent charging hardware device and related accessories (“Equipment”) provided by EN Plus.

 

Other Rights You May Have. Although this warranty gives you specific legal rights, you may have other rights in your jurisdiction. This statement of limited warranty is subject to applicable laws that apply to you and the equipment. Please review the laws in your jurisdiction to understand your rights fully.

Who is Covered by EN Plus’s Limited Warranty?

This limited warranty statement covers the equipment users— individuals who purchased equipment from EN Plus or one of its authorized resellers or distributors or who received equipment as a gift from such a purchaser.

1. Limited Warranty Coverage

For three (3) years from your purchase, EN Plus warrants that the Equipment shall be free from defects in material and quality under regular use and service.

2. Warranty Benefits

If, during the applicable warranty period, the user returns defective Equipment to EN Plus, accompanied by EN Plus’s return authorization form, and EN Plus determines to its satisfaction that the Equipment is defective due to reasons not caused by abuse, misuse, neglect, alteration, improper installation, repair, improper testing, accident, natural disaster, or use contrary to any instructions issued by EN Plus, then EN Plus shall, at its sole discretion, either repair, replace, or refund to the user the lesser of the standard retail purchase price of such Equipment or the purchase price paid by the user as shown on their proof of purchase. EN Plus requires that the user obtains a return authorization form prior to returning the Equipment, and no Equipment may be returned to EN Plus without such form.

3. Obtaining Limited Warranty Service

For warranty service, contact EN Plus for shipping instructions and a return authorization form at support@en-plus.com.cn. Please ship the equipment to EN Plus with proof of purchase, which is required to obtain repairs, replacement, or refunds under this limited warranty statement. The user will need to pay for the shipment of the equipment to EN Plus. EN Plus will pay for the shipment of any repaired or replaced equipment.

 

4. Sole and Exclusive Warranty

The preceding warranty constitutes EN Plus’s exclusive liability, and the sole and exclusive remedy of the user, for any breach of any warranty or other nonconformity of the Equipment covered by this statement of limited warranty. This warranty is exclusive and instead of all other warranties. No employee of EN Plus or any other party is authorized to make any warranty in addition to the warranty in this statement of limited warranty.

5. Disclaimer of Warranties

Except as warranted above, to the maximum extent permitted by applicable law, EN Plus provides the Equipment “as is.” EN Plus makes no other warranties, express, implied, or statutory, and EN Plus hereby disclaims all warranties, representations, or conditions, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow exclusions of an implied warranty, so this disclaimer may not apply to you, and you may have other legal rights that vary by jurisdiction.

6. Limitations of Liability

Under no circumstances whatsoever shall EN Plus or its suppliers be liable for indirect, special, incidental, or consequential damages, even if EN Plus or one of its suppliers has been advised of the possibility or likelihood of such damages. Except as covered by this statement of limited warranty, EN Plus shall not be liable for costs associated with the replacement or repair of the product, including, but not limited to, labor, installation, or other costs incurred by the user and, in particular, any costs relating to the removal or replacement of any product. In no event shall EN Plus’s liability for any and all claims, losses, or damages arising out of or relating to, in whole or in part, this statement of warranty or the Equipment, whether under contract, tort, negligence, statute, or otherwise, exceed the purchase price paid by the user for the Equipment. The preceding limitations and exclusions of damages shall apply to the maximum extent permitted by applicable law. In some jurisdictions, some exclusions or limitations may not apply to you.

7. Exclusions from Warranty Coverage

This statement of limited warranty does not cover damage caused by abuse, misuse, neglect, alteration, improper installation, repair, testing, accident, natural disaster, or use contrary to any instructions issued by EN Plus.
